Influencer Application Terms & Conditions

Effective Date: Application Submission

These Terms and Conditions ("Agreement") govern the application process and participation of influencers ("Influencer", "you", or "your") in the Fae Ball Events: Myths & Legends Kansas City 2026 ("Event") organized by Fae Ball Productions, LLC ("Organizer", "we", or "us"). By submitting an application to participate as an Influencer at the Event, you agree to comply with these Terms and Conditions.

1. Application and Acceptance

1.1 Application Process: Influencers must complete the official Influencer Application Form and submit it for review. The submission does not guarantee acceptance. The Organizer will review all applications and notify you of acceptance based on criteria including, but not limited to, brand relevance, social media influence, and available space.

1.2 Approval and Confirmation: If your application is approved, the Organizer will send you a formal confirmation with event details, schedules, and terms of participation.

2. Event Role

2.1 Event Role: As an Influencer, you are expected to actively participate in the Event by engaging with attendees, promoting the Event on your social media platforms, attending photo ops, and performing other activities as required by the Organizer.

2.2 Engagement with Attendees: You are expected to engage with Event attendees in a professional, friendly, and respectful manner at all times. You must refrain from inappropriate or disruptive behavior during the Event.

2.3 Social Media Promotion: As part of your participation, you agree to promote the Event on your social media channels (Instagram, Facebook, TikTok, etc.), using official event hashtags and tagging the Event's social media accounts, and in a positive manner. Specific promotional guidelines will be provided by the Organizer.

2.4 Social Media Post Requirements: As part of your participation, you agree to: make at least three unique posts on your social media channels prior to the Event, at least one post on your social media channels during the Event, and at least one post on your social media channels after the event.

3. Content Creation and Usage

3.1 Photos and Videos: The Organizer may take photos, videos, or other media of your participation during the Event. By participating, you grant the Organizer permission to use this content for marketing, promotional, and social media purposes without additional compensation or approval.

3.2 Personal Content: You may also create and share content from the Event on your personal social media channels, provided it follows the Event's content-sharing guidelines, including any embargoes or restrictions on specific announcements.

3.3 Branding and Sponsorships: If you have brand partnerships, sponsors, or collaborations, you must ensure that your promotional activities do not conflict with the Event's sponsors or other partners. Any external brand promotion must be approved by the Organizer in advance.

4. Compensation and Fees

4.1 Compensation: The Event is offering compensation of free entry equivalent to VIP access. Does not include a VIP gift bag.

4.2 Travel and Accommodation: Unless otherwise specified, you are responsible for your own travel, accommodation, and other expenses related to your participation in the Event.

4.3 Sales and Merchandise: If you plan to sell merchandise or items at the Event, you must receive prior approval from the Organizer. Sales of any kind without prior approval may result in removal from the Event.

5. Liability and Insurance

5.1 Personal Property: You are responsible for securing and maintaining your personal property, including costumes, props, merchandise, and promotional materials. The Organizer is not liable for any loss, theft, or damage to your personal property during the Event.

5.2 Liability Insurance: If necessary, you are encouraged to obtain liability insurance for your participation. The Organizer is not liable for any injuries or incidents caused by your actions, your merchandise, or your cosplay at the Event.

5.3 Indemnity: You agree to indemnify and hold harmless the Organizer, its employees, agents, and contractors from any claims, damages, losses, or liabilities arising from your participation, including but not limited to claims related to injury, property damage, or intellectual property infringement.

6. Health and Safety

6.1 Compliance with Health Guidelines: You must comply with all health and safety guidelines in place at the time of the Event, including any COVID-19-related protocols (if applicable). Non-compliance may result in removal from the Event.

6.2 Costume Safety: You are responsible for ensuring that your cosplay or costume is safe and does not pose a risk to yourself or others. The Organizer reserves the right to request modifications to your costume if it is deemed unsafe, overly disruptive, or in violation of Event guidelines.

7. Cancellations

7.1 Influencer Cancellations: If you are unable to attend the Event after being accepted, you must notify the Organizer as soon as possible. If you cancel after the registration deadline, you may be subject to penalties for future event participation.

7.2 Event Cancellations: The Organizer reserves the right to cancel, reschedule, or modify the Event due to unforeseen circumstances, including but not limited to natural disasters, government restrictions, or other uncontrollable events. In such cases, you will be notified promptly.

8. Intellectual Property and Copyright

8.1 Cosplay Content: You represent and warrant that you have the necessary rights and permissions for any intellectual property (e.g., costumes, props, designs, etc.) associated with your participation in the Event.

8.2 Event Content: The Organizer owns all rights to the Event's branding, promotional materials, and media produced by the Event. You may not use any of the Organizer's intellectual property without prior written consent.

9. Force Majeure

9.1 Non-Performance: The Organizer shall not be held liable for any failure to perform their obligations under this Agreement due to causes beyond their control, including but not limited to natural disasters, pandemics, strikes, or government-imposed restrictions.

10. Modification of Terms

10.1 Amendments: The Organizer reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be communicated to the Influencer in writing or by email prior to the Event.

10.2 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Kansas. Any disputes arising out of or in connection with this Agreement shall be submitted to binding arbitration under the American Arbitration Association Commercial Arbitration Rules and conducted in the Kansas City, Kansas metropolitan area with an AAA approved arbitrator mutually agreed upon by the parties.

11. Agreement

By submitting this Application, the Influencer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
