Media Application Terms & Conditions

Effective Date: Application Submission
These Terms and Conditions ("Agreement") govern the application process and participation of media ("Media", "you", or "your") for all Fae Ball Events ("Event") organized by Fae Ball Productions, LLC ("Organizer", "Company", "we", or "us"). For purposes of this Agreement, "Company" includes Fae Ball Productions, LLC, its subsidiaries, sponsors, employees, assigns, and related organizations, as well as those for whom Company is acting and those acting with its authority and permission. The "Event" includes the Fae Ball event and all pre-event meetings, company-sponsored functions, and sponsored shows. By submitting an application to participate as Media at any Event, you agree to comply with these Terms and Conditions.
1. Application and Acceptance
1.1 Application Process: Media must complete the official Media Application Form and submit it for review. The submission does not guarantee acceptance. The Organizer will review all applications and notify you of acceptance based on criteria including, but not limited to, brand relevance, publication reach, portfolio quality, and available space.
1.2 Approval and Confirmation: If your application is approved, the Organizer will send you a formal confirmation with event details, schedules, and terms of participation.
2. Event Role
2.1 Event Role: As Media, you agree to shoot images of the Event by providing candid, paparazzi-style images of the participants, attendees, invited celebrity guests, staff, and models throughout the Event.
2.2 Image Delivery: You will provide all images in high-definition electronically to the Company's designee within three (3) weeks of the Event.
2.3 Engagement with Attendees: You are expected to engage with Event attendees, guests, staff, and models in a professional, friendly, and respectful manner at all times. You must refrain from inappropriate or disruptive behavior during the Event.
2.4 Social Media Promotion: As part of your participation, you agree to promote the Event on your social media channels (Instagram, Facebook, TikTok, etc.), using official event hashtags and tagging the Event's social media accounts, and in a positive manner. Specific promotional guidelines will be provided by the Organizer.
3. Limited License and Content Usage
3.1 Grant of License: In consideration of good and valuable consideration herein acknowledged as adequate and received, you hereby grant and assign to Company a perpetual license and permission to use the photos, videos, and other reproductions taken by you during the Event. Company has the irrevocable, perpetual, and unrestricted right, permission, and license to take, assign, use, re-use, publish, edit, and republish videos, photographic portraits, or pictures you take, in whole or in part, or reproductions thereof, made through any medium, and in any and all media now or hereafter known for print media and electronic media and distribution over the internet for illustration, promotion of the Company or its sponsors, model, art, editorial, submission to media or trade magazines, or any other purpose.
3.2 No Resale: You understand that the Company will not sell the images you take.
3.3 Organizer Content: The Organizer may also take photos, videos, or other media of your participation during the Event. By participating, you grant the Organizer permission to use this content for marketing, promotional, and social media purposes without additional compensation or approval.
3.4 Personal Content: You may share content from the Event on your personal social media channels, provided it follows the Event's content-sharing guidelines, including any embargoes or restrictions on specific announcements.
3.5 Branding and Sponsorships: If you have brand partnerships, sponsors, or collaborations, you must ensure that your promotional activities do not conflict with the Event's sponsors or other partners. Any external brand promotion must be approved by the Organizer in advance.
4. Compensation and Fees
4.1 No Monetary Compensation: You understand and agree that Company will not compensate you for your participation, the images you take, or the license granted herein.
4.2 Event Access: The Organizer is offering complimentary event entry equivalent to VIP access. This does not include a VIP gift bag.
4.3 Travel and Accommodation: Unless otherwise specified, you are responsible for your own travel, accommodation, equipment, and other expenses related to your participation in the Event.
4.4 Sales and Merchandise: If you plan to sell merchandise, items, or services at the Event, you must receive prior approval from the Organizer. Sales of any kind without prior approval may result in removal from the Event.
5. Release and Hold Harmless
5.1 General Release: You hereby release, discharge, and agree to hold harmless Company, its heirs, legal representatives, and assigns, and all persons acting under its permission or authority or those for whom it is acting, from any liability for any injuries to yourself.
5.2 Release for Image Use: You hereby release, discharge, and agree to hold harmless Company, its heirs, legal representatives, and assigns from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of such images as well as any publication of them, including without limitation any claims for libel or violation of any right of publicity or privacy.
5.3 Personal Property: You are responsible for securing and maintaining your personal property, including cameras, equipment, props, merchandise, and promotional materials. The Organizer is not liable for any loss, theft, or damage to your personal property during the Event.
5.4 Liability Insurance: If necessary, you are encouraged to obtain liability insurance for your participation. The Organizer is not liable for any injuries or incidents caused by your actions or your equipment at the Event.
5.5 Indemnity: You agree to indemnify and hold harmless the Organizer, its employees, agents, and contractors from any claims, damages, losses, or liabilities arising from your participation, including but not limited to claims related to injury, property damage, or intellectual property infringement.
6. Health and Safety
6.1 Compliance with Health Guidelines: You must comply with all health and safety guidelines in place at the time of the Event, including any COVID-19-related protocols (if applicable). Non-compliance may result in removal from the Event.
6.2 Equipment Safety: You are responsible for ensuring that your equipment is safe and does not pose a risk to yourself or others. The Organizer reserves the right to request modifications to your equipment setup if it is deemed unsafe, overly disruptive, or in violation of Event guidelines.
7. Cancellations
7.1 Media Cancellations: If you are unable to attend the Event after being accepted, you must notify the Organizer as soon as possible. If you cancel after the registration deadline, you may be subject to penalties for future event participation.
7.2 Event Cancellations: The Organizer reserves the right to cancel, reschedule, or modify the Event due to unforeseen circumstances, including but not limited to natural disasters, government restrictions, or other uncontrollable events. In such cases, you will be notified promptly.
8. Intellectual Property and Copyright
8.1 Your Content: You represent and warrant that you have the necessary rights and permissions for any intellectual property associated with your participation in the Event, and that your grant of license to Company under Section 3 does not infringe upon the rights of any third party.
8.2 Event Content: The Organizer owns all rights to the Event's branding, promotional materials, and media produced by the Event. You may not use any of the Organizer's intellectual property without prior written consent.
9. Force Majeure
9.1 Non-Performance: The Organizer shall not be held liable for any failure to perform their obligations under this Agreement due to causes beyond their control, including but not limited to natural disasters, pandemics, strikes, or government-imposed restrictions.
10. Modification of Terms
10.1 Amendments: The Organizer reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be communicated to the Media in writing or by email prior to the Event.
10.2 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Kansas. Any disputes arising out of or in connection with this Agreement shall be submitted to binding arbitration under the American Arbitration Association Commercial Arbitration Rules and conducted in the Kansas City, Kansas metropolitan area with an AAA approved arbitrator mutually agreed upon by the parties.
11. Agreement
By submitting this Application, you acknowledge that you have read the above authorization, release, and agreement, prior to its execution, and that you are fully familiar with the contents of this document. This document shall be binding upon you and your heirs, legal representatives, and assigns.
